National Broadcasting Council bans TV channels “Dozhd” and “Teleklub” to rebroadcast in Ukraine

January 12, the National Television and Radio Broadcasting Council excluded the Russian TV channel “Dozhd” from the List of Foreign Broadcasts, the content of which meets the requirements of the European Convention on Transfrontier Television and the laws of Ukraine. The regulatory authority also banned the TV channel under German jurisdiction “Teleklub” to rebroadcast in Ukraine for three months. This is featured by the specialized edition “Detector Medіa”.

The TV channel “Dozhd” is excluded from the List because of broadcasting advertising that is prohibited by the Ukrainian law (the law disallows advertising in the broadcasts of Russian TV channels distributed over Ukraine), as well as in view of broadcasting information, encroaching on the territorial integrity of Ukraine (“Dozhd” depicts the Crimea as the territory of the Russian Federation).

The exclusion resolution shall take effect one month after its publication (roughly on February 13).

The owner and head of the TV channel Natalia Sindeeva informed the National Council that “Dozhd” had created an individual online version for Ukraine without any advertising. However, the National Council did not receive any documents from “Dozhd” to put that Ukrainian version into the List of Foreign Channels. In addition, the channel did not solve the issue of rebroadcasting that individual version with the Ukrainian providers.

The TV channel “Teleklub” operates under the jurisdiction of Germany, EU member state. In the channel’s airtime, the National Council detected movies produced in Russia, which were banned by the Ukrainian laws. The Chairman of the National Council Iurii Artemenko said that the National Council had been held long discussions with the channel, referring to the channel’s distributor to remedy violations. The distributor reported that it had delivered the regulatory authority’s requests to the channel’s management. But the content policy of “Teleklub” remained unchanged.

Iurii Artemenko offered not to ban “Teleklub”, but to appeal to the German regulator to influence on its licensee. But the member of the National Council Valentyn Koval points out that the German laws does not provide for restrictions on showing Russian movies, so the German regulator is unlikely to ask anything of “Teleklub” at the request of its Ukrainian counterpart.

He was endorsed by the member of the National Council Oleh Chernysh, who stresses that “Teleklub” is a Russian channel with German license.

Thus, the majority of the members of the National Council (except for Iurii Artemenko) voted to suspend rebroadcasting TV channel “Teleklub” in Ukraine provisionally for three months, as well as to notify the German regulator about that Ukraine’s decision.

Let us recall that as of December 22, the List of Foreign Broadcasts (the so-called “List of Adapted Channels”) accounted for 156 foreign TV channels. After excluding “Dozhd” and temporary banning “Teleklub”, the Ukrainian providers are allowed to rebroadcast 154 foreign TV channels.
