Kyiv District Administrative Court assigned a comprehensive psychological and linguistic expert examination of the content of Russian channels prohibited for broadcasting in Ukraine. This is stated in its judgement from March 3. A copy of this document is available for EP.
We shall recall that on March 25, 2014 the court prohibited provisionally the propagation of four Russian channels in Ukrainian territory as an injunctive remedy under the plaintiff’s statement, the National Television and Radio Broadcasting Council. The sanction bore upon four broadcasters – Channel One, NTV, Russia 24 and RTR.
On July 17 it became known that the court prohibited provisionally the propagation of TV Center-International (ТVСІ), one more Russian channel. In February 2015 the both suits were combined in one case.
The National Council looks forward to recognizing the above mentioned channels inconsistent with the Ukrainian laws and the European Convention.
On March 3 the court granted the National Council’s petition in part, assigning an expert examination of the channels’ content to be held by Kyiv Research Institute of Forensic Examinations within the Ministry of Justice of Ukraine.
They’ll have to find out whether the electronic audiovisual media subject to examining contain fragments with incitements to a forcible change of the constitutional system of Ukraine; incitements to war outbreak, aggressive actions of their propaganda; fragments with propaganda of exceptionality superiority or inferiority of people in view of their religious convictions.
Including ideology, nationality or ethnicity, physical or property status, social origin; fragments with infringement on the territorial integrity of Ukraine, incitements to public disorders and mass riots.
The representatives of three Russian channels opposed the expert examination and the delegate of the Public Prosecutor’s Office seconded the National Council’s initiative.
