TV Channel “Pyatnitsa!” Wins a Life-term Ban of the Third Largest Video Hosting

The Roskomnadzor received the Moscow City Court’s order of the so-called “life-term ban” of the Dailymotion service, which is the world’s third largest video platform in terms of number of users, being second only to YouTube and Vimeo.

The Moscow City Court sustained the claim of the TV channel “Pyatnitsa!” (Friday!), incorporated into the holding “Gazprom-Media”, against the French video hosting Dailymotion for copyright violation, as the “Gazeta.ru” features. The cause of claim lies in violating anti-piracy laws in Russia.

The “Gazprom-Media”’s press release states that in the past year, “Pyatnitsa!” sent several letters of claim to the video hosting’s head office. They requested the hosting to remove releases of the top-rated TV shows like “Revizorro”, “Magazzino”, “Tomboys” and others.

“However, the Dailymotion did not give any response”, as the media holding’s press release states.

As a result, the above shows were removed from the video service just after May 2016, when the Moscow City Court ruled on the compulsory removal of the content that violated copyrights. The court order was abided by, but in August 2016, uploading “Pyatnitsa!”-owned TV shows on Dailymotion resumed.

In this regard, the TV channel’s management re-applied to the court for provisional interim injunctive measures. Then, there were filed a suit to the court, claiming to block the Dailymotion’s operation in Russia. On 2 December 2016, the Moscow City Court sustained the TV channel’s claim.

The Dailymotion chose to ignore that ruling and failed to file any appeal within specified time limits. Consequently, the court decision was submitted to the Roskomnadzor for a “life-term” ban of that video service.

“The projects of the TV channel “Pyatnitsa!” and other entertainment channels of the “Gazprom-Media” Holding can be legally watched free of charge on the TV channels’ official web sites and video service Rutube”, as stated in a press release.

The Dailymotion is owned by the French media corporation Vivendi, which also incorporates the pay-TV giant Canal Plus Group and the Universal Music Group. The deal to acquire a platform, worth 217 million euros, was closed in the summer of 2015.

“Pyatnitsa!”, along with five other terrestrial channels like “NTV”, “TNT”, “TV-3”, “TNT4” and “Match TV”, forms part of the holding “Gazprom-Media”.
