Israeli satellite operator Spacecom is sueing Inter Media Group

Since 2009, nine TV channels from Inter Media Group have had signed agreements with Spacecom for broadcast over Spacecom’s AMOS-3 satellite located at 4°W orbital position. However, recently Inter Media Group’s channels have early terminated the agreements in order to move their signals to another satellite operator. This has been done without any proper legal basis and represents a breach of the agreements between the channels and Spacecom.

In light of this, Spacecom has sued Inter Media Group’s TV channels in the Commercial Court of the City of Kyiv asking the Court to annul the unilateral early termination by the channels of their agreements with Spacecom. Spacecom has also sought an injunction against broadcast of the channels on SES’ Astra 4A or any other satellite in breach of Spacecom’s agreements with the channels.

On January 14, 2016, the Commercial Court of the City of Kyiv agreed with Spacecom and granted an injunction requiring Inter Media Group’s TV channels to immediately cease broadcast on another satellite.

Spacecom expects compliance with the injunction. Failure to comply with the injunction entails liability under applicable law.
